Kok's team wants High Court hearing

PETALING JAYA: The defence team for Seputeh MP Teresa Kok (pix) prefers her sedition case to be heard in the High Court rather than the sessions court.
When contacted by theSun today, Kok's lawyers Sankara Nair and Datuk Param Cumarasamy said they had asked the prosecution (DPP Muhamad Iskandar Ahmad) informally on Tuesday whether the prosecution would consider transferring the case to the Kuala Lumpur High Court.
"We are waiting for a reply," said Nair.
He said if the prosecution does not apply for the transfer, the defence would do so.
He said if the case is heard in the High Court, then its final appeal can be made to the Federal Court.
If the case is heard at a lower court such as the sessions court, the final appeal will stop at the Court of Appeal.
He said this is the reason for seeking the transfer to the High Court.
"This is the first stage. We will take it as the matter develops," said Nair.
When asked whether the defence would write to the Attorney General to consider withdrawing the charges, Nair said: "We have not come to that conclusion."
On Tuesday, Kok, 50, who is DAP vice-chairman, was charged under the Sedition Act 1948 for publishing a video clip titled Teresa Kok Onederful Malaysia CNY 2014.
