High Court allows appeal for PKR member against acquittal decision

GEORGETOWN: The Penang High Court today allowed an appeal by the prosecution to grant a PKR member a discharge not amounting to an acquittal after he was acquitted in a lower court last year.

Judicial Commissioner Datuk Nordin Hassan in his decision ruled sessions court Judge Meor Sulaiman Ahmad Tarmizi had erred in his decision after Ong Eu Leong, 46, was acquitted in July last year for failing to give a 10-day notice of the Blackout 505 rally in 2013.

Nordin noted that an acquittal can be made either at the end of the prosecution case or at the last part of the defence.

“The court however can close the case at any stage but this does not amount to an acquittal,” he said.

Ong was charged with committing the offence under the Peaceful Assembly Act 2012 at the Batu Kawan Stadium about 8pm on May 11, 2013.

He was defended by Lim Boon Beng while Deputy Public Prosecutor Datuk Razali Che Ani prosecuted.
