SHAH ALAM: The mother of a 15-year-old boy, who was allegedly shot dead by the police, cried when giving evidence about the bullets wounds on her son's forehead and chest at the High Court here today.
Norhafizah Mad Razali, 41, the mother of Muhammad Shamil Hafiz Shapiei, was in tears when Senior Federal Counsel Norliza Zulkifli suggested that her statements were mere allegation and imagination.
Her son and his two friends, Mohd Hairul Nizam Tuah, 20, and Muhammad Hanafi Omar, 22, were shot in the early hours on Nov 13, 2010, at Glenmarie, near here.
In the statement of claim, Norhafizah said she suffered from "nervous shock", mental distress and deep sorrow over the death.
"It's not true, Yang Arif," said Norhafizah in a loud voice and started to cry.
In her re-examination, lawyer Latheefa Koya asked about Shamil's bullet wounds on his body.
"I saw for myself, the bullet wounds in the head and his chest," said Norhafizah.
Norhafizah, 41, along with family members of the other deceased, Hamidah Kadar, the mother of Mohd Hairul and Omar Abu Bakar, the father of Muhammad Hanafi and three others had filed a suit on Aug 12, 2014.
They are suing Shah Alam district police chief, Selangor state chief, Inspector-General of Police and the government for misfeasance in public office.
They also named Inspector Azrin Ezahar, Corporal Kamarul Zaman Awang, Lance Corporal Khairul Azahar Jali, Lance Corporal Mohd Juhaimi Jasmin, Lance Corporal Mohd Aminuddin Affendi Azmi, Constable Halfiz Ibrahim and Constable Nafis Akmal Ismail as respondents.
They are seeking for a declaration that the defendants had purposely and with bad intention contravened the deceased's fundamental freedom and seeking general, aggravated and exemplary damages.
They claimed that the deceased were shot "execution" style and that the bullet wounds were not consistent with the police's story.
Norhafizah said the police claimed that her son was a member of "Geng Minyak".
The defendant's witness, Inspector Azrin Ezahar, testified that one of the deceased ran towards him with a parang and that he shot twice and the deceased fell.
During cross-examination by Latheefa, Azrin said he till now does not know who he shot.
Another witness, Kamarul Zaman, also gave a similar version.
He also said that one of the deceased tried to attack him with a parang and that he shot twice and does not know who he shot till now.
The hearing before High Court judge Datuk Rozana Ali Yusoff continues tomorrow.
