Nik Nazmi's suit against Abdul Gani fixed for case management on July 14

    KUALA LUMPUR: A civil suit by Selangor state executive councillor and PKR Youth chief Nik Nazmi Nik Ahmad against Attorney-General Tan Sri Abdul Gani Patail and the government is fixed for case management on July 14.
    The case was brought up before High Court deputy registrar K. Pavani today.
    In the statement of claim, Nik Nazmi, 33, who is Seri Setia assemblyman, had claimed “malicious prosecution” and “misfeasance in public office” by Gani.
    Nik Nazmi claimed that he was discharged from a charge but charged again with a similar offence.
    In the suit, Nik Nazmi, as the organiser of the “Negeri Selangor Explanation Program” (Program Penerangan Negeri Selangor) event, was charged with failing to inform the Petaling Jaya district police chief 10 days before the programme.
    He applied for the charge to be set aside but a High Court rejected the application.
    Subsequently, the Court of Appeal overturned the High Court decision and set aside his charge.
    Nik Nazmi said on April 28, 2014, the prosecutor filed for an appeal against the decision at the Federal Court.
    On May 5, 2014, the case was brought back to the Sessions Court, which confirmed the Court of Appeal decision and set aside his charge.
    Later, Nik Nazmi was brought to a Sessions Court again to face a similar charge under the same section although the Court of Appeal had made its decision.
    However, the Sessions Court ordered a discharge not amounting to an acquittal due to the Court of Appeal’s decision.
    Nik Nazmi is seeking RM80,000 special damages, general, exemplary and aggravated damages, costs, interests and other reliefs deemed fit and proper by the court.
