Oct 29 hearing for PKR Youth chief's case against ex-attorney general

    KUALA LUMPUR: The High Court today set two days, from Oct 29, to hear PKR youth chief Nik Nazmi Nik Ahmad's lawsuit against then Attorney-General Tan Sri Abdul Gani Patail.
    Justice Vazeer Alam Mydin Meera set the date in chambers during which the plaintiff's counsel Melissa Sasidaran and senior federal counsel Zureen Elina Mohd Dom were present.
    Melissa told reporters when met that the court had fixed Sept 30 for case management of the witness statements filed by both parties.
    Nik Nazmi, 33, who is also Seri Setia assemblyman, filed the suit last March 31, naming Abdul Gani and the government as first and second defendant.
    In his statement of claim, he alleged Abdul Gani had with malicious intent caused him to be charged in the Petaling Jaya Sessions Court for the second time on May 6, 2014.
    This was despite the Appeal Court's decision on April 25, 2014, to grant his appeal and drop the charge against him under Section 9(5) of the Peaceful Assembly Act 2012, he alleged.
    He said he was earlier charged in the same Sessions Court on May 17, 2013, for allegedly organising a rally at Stadium Majlis Bandaraya Petaling Jaya on May 8, 2013.
    He said on May 6, 2014, the sessions court again acquitted and discharge him after ruling it was bound by the court of appeal's decision to declare his prosecution under Section 9(5) as unconstitutional.
    Nik Nazmi alleged that Abdul Gani's action to charge him twice on the same charge had damaged his reputation and portrayed him as a criminal who was a threat to the security of the country.
    He is claiming special damages of RM80,000, general, aggravated and exemplary damages and other relief deemed fit by the court. – Bernama
