Tun M files application to call PM Najib to appear in court for cross examination

KUALA LUMPUR: Former Prime Minister Tun Dr.Mahathir Mohamad (pix) and two others filed an application to call current Prime Minister Datuk Seri Najib Abdul Razak to appear in court to be cross examined.
Dr Mahathir, Datuk Seri Khairuddin Abu Hassan and Anina Saadudin, who had filed a civil suit against Najib for alleged abuse of power on March 23, 2016, filed the application through Messrs Haniff Khatri at the High Court registry, today.
The three are seeking for an order to call Najib for the purpose of cross examination on a date to be fixed by the court, in relation to the content of Najib's affidavit.
(Najib had filed a supporting affidavit on April 12, 2016 to strike out the civil suit)
They claim that if Najib fails to appear for cross examination, then the affidavit should not be used in the court proceedings.
According to the grounds of the application, Najib had allegedly gaven statements, which were "equivocal" and "lack of precision", contradictory and "inconsistent with undisputed contemporary facts in the public domain or other statements by the defendants."
They said in a paragraph in the affidavit, Najib had claimed that "in his capacity as the PM, Finance minister, Barisan Nasional president and Umno president" and not as a "public servant".
