Four months jail and 1k fine for man who stole phone in Low Yat

KUALA LUMPUR: The magistrate's court today sentenced an unemployed man to four months' jail and fined him RM1,000, after he was found guilty of stealing a handphone at Low Yat Plaza in July, last year.
Magistrate Nur A'minahtul Mardiah Md Nor, in her judgment, said the defence had failed to raise any reasonable doubts in the prosecution's case.
She ordered the sentence on Shahrul Anuar Abdul Aziz, 23 to begin from today.
Shahrul was charged with stealing a Levono S860 mobile phone, worth RM800, from Techasia Boutique in Low Yat Plaza, Bukit Bintang, at about 4.47pm last July 11.
The charge, under the Penal Code, carries a jail term of up to 10 years and fine, on conviction.
In mitigation, counsel Shaharudin Ali, for Shahrul, said his client comes from a poor family, where his father was a former sweeper and mother is a housewife.
He also said his client was studying for seven months at Akedemi Binaan Malaysia to be a backhoe operator before the incident last year.
"He was going through stress on the day of the incident as he had his handphone and wallet robbed in the morning," he added.
Shaharudin also told the court that Shahrul has two other charges against him, one of which for he was fined RM2,000 for consuming drugs.
However, DPP S Malini Anne asked for a deterrent sentence as this was a serious offence and also that the accused was under the influence of drugs when committing the offence.
"He was 22 years old, an adult, when he committed the offence, and he should be aware that stealing is a serious offence," she said.
After the sentencing, Shaharudin asked the court for a stay of execution to appeal against the jail term, which Nur A'minahtul granted.
