KUALA LUMPUR: The High Court has allowed the "voice recording" and communication transcripts between Malaysian Airlines System Bhd (MAS) and the missing MH370 airplane to be disclosed to the family of the passengers.
The family of three passengers had filed for a "discovery of document" against the defendants, MAS and Malaysian Airlines Berhad (MAB), to disclose the documents.
The voice recording was among several documents sought by the family.
The High Court allowed an application for discovery against both the defendants, on the grounds it is relevant and necessary for a fair trial, said lawyer Sangeet Kaur Deo, who is representing a family of five.
Among the documents were "Aircraft Communications Address and Reporting System" logs (ACARS log) in the form of voice recording or data sent or received from the flight before the departure and Air Ground Communication Recording."
Other documents included MAS's Standard Operating Procedures (SOP) to track flights at the time of departure until arrival at the destination.
MH370 departed at 12.42am on March 8, 2014, from Kuala Lumpur International Airport (KLIA) but could not be contacted later.
After the decision, the civil proceedings in the court were stayed pending an appeal against it. Sangeet said MAS had indicated it would file an appeal.
The family had also filed an appeal against a decision made on March 30, this year, in which the High Court struck out three defendants named by the family, in the suit.
On Aug 28, 2015, the five members sought for compensation over the disappearance of Tan Ah Meng, 46, and his wife Chuang Hsiu Ling alias Cindy Chuang, 45, who were directors of an engineering and a construction company and their eldest son, Tan Wei Chew, 19.
The suit was filed by the couple's two other children - Tan Wei Hong, 15, and Tan Wei Jie, 13 – Ah Meng's parents Tan Hun Khong, 84, and Lai Chew Lai, 82, and Hsiu
Ling's mother Chuang Hung Chien, 75 , a Taiwanese citizen.
