KUALA LUMPUR: The Sessions Court today acquitted and discharged three men, including a Federal Territory Land and Mines Office assistant director, for forgery of documents.
Judge Zulqarnain Hassan made the decision after DPP Hidayatul Syuhada Shamsudin informed the court the prosecution did not intend to continue with the case against Mohammad Irwan Adnan, 40, and businessman S. Ganesan, 40, and K. Barthen, 53.
Hidayatul Syuhada said the prosecution was withdrawing the charge against them after the Attorney-General's Chambers received, and was satisfied with, the representation sent by them.
In acquitting and discharging the three men, Judge Zulqarnain ordered the bail of RM20,000 each posted by them to be returned.
On June 22, 2012, Mohammad Irwan was charged with forging a valuable security in the form of a land title for Lot 328, Section 92, Bandar Kuala Lumpur by inserting the name of Fanaz Sdn Bhd as the owner when it did not belong to the company.
The offence was allegedly committed at his office at Tingkat 0-4, Rumah Persekutuan, Jalan Sultan Hishamuddin here, between 8am and 6.30pm on June 21, 2007.
Ganesan was charged with dishonestly using the document, which he knew was forged, to transfer ownership of the land to Indah Kitar Semula Sdn Bhd, at the same place between July 9, 2007, and May 12, 2008.
Barthen was charged with abetting Ganesan in committing the alleged offence. — Bernama
