Former chef gets eight years' jail for causing death of Bangladeshi man

JOHOR BARU: A former cook was today sentenced to eight years' jail by the High Court here after he pleaded guilty to an alternative charge of causing the death of a Bangladeshi man, two years ago.
Judge Datuk Mohd Sofian Abd Razak also ordered Ahmad Izwan Mohamad Yatim, 30, to serve the sentence from the date of his arrest on Sept 2, 2014.
According to the alternative charge, Ahmad Izwan was accused of committing culpable homicide not amounting to murder of Emdadul Islam, in front of a house at Jalan Pinang 1, Taman Kota Kulai, Kulai, near here, between 1pm and 1.30pm on July 9, 2014.
The charge under Section 304 (b) of the Penal Code, provides for a maximum jail term of 10 years or a fine, or both, upon conviction.
Ahmad Izwan, who is unmarried, was initially charged with killing Emdadul Islam under Section 302 of the Penal Code, which carries the mandatory death sentence if convicted.
Earlier, deputy public prosecutor Norafiah Saini asked the court to impose a deterrent sentence to the accused on grounds that he had broken into the foreign worker's house and was involved in a fight with Emdadul Islam.
Ahmad Izwan's lawyer Mohd Daud Ismail, however, requested for leniency as his client had pleaded guilty to the alternative charge and he had to take care of his ailing parents.
In his judgement after hearing submissions from the prosecution and defence, Mohd Sofian said the court imposed the sentence after taking into account the public interest.
"Although the accused only wanted to defend himself, the incident would not have happened if he did not break into the house and the accused should have thought about the consequences of his action," he said. — Bernama
