Company ordered to settle GST arrears totaling RM889,516.19

SHAH ALAM: The High Court here today ordered an information technology services company to settle the balance of RM889,516.19 in goods and services tax (GST) it owed the Malaysian government.
The GST civil action against Nuemera (M) Sdn Bhd is the first case of its kind in the country.
The Malaysian government as plaintiff named Nuemera and three of its directors, Shahriza Kamaruzzaman, Mohd Noor Amin Mohd Noor Khan and Nur Jasni Mohamed as defendants.
It named the Malaysian Communications and Multimedia Commission (MCMC) as third party in the action filed on Jan 15.
Justice Ahmad Azhari Abdul Hamid in chambers ordered the defendants to settle the amount today and also ordered the plaintiff to withdraw the action when payment has been made.
The plaintiff was represented by Selangor Customs Enforcement Division, prosecution branch assistant director Abdul Rasyiddi Ab Drahman while the defendants, by counsel Carmelila Cheong and Soo Yee Fei, and MCMC, by counsel Gabriel Cheah.
In its statement of claim, the plaintiff defined Nuemera as a taxable person and a registered person under Part IV of the GST Act 2014.
According to the plaintiff, the company as a person registered under the said Act, must submit the GST statement and settle the amount accordingly.
It said it did receive a GST statement from the defendants on Aug 13, 2015, which did not include any payment.
The plaintiff further said it issued a bill claim under the GST Act 2014 dated Aug 25, 2015 to Nuemera for RM988,351.32, for the taxable period between April 1, 2015 and June 30, 2015.
However, said the plaintiff, Nuemera only settled RM98,835.13 on Dec 16, 2015 leaving RM889,516.19 unpaid.
The plaintiff said it made various efforts to get the defendants to pay up, which proved futile.— Bernama
