PETALING JAYA: The Attorney-General's Chambers (AGC) has declared that the case involving an alleged organ trafficking syndicate highlighted by theSun has no substantive evidence for charges to be filed.
In a statement issued today, the AGC referring to the report titled Preying on the desperate and clarified that the department had received the investigation papers on the case on Aug 26.
"Following a briefing on the case from the investigation officer and taking into account statements which were submitted in the investigation papers, the department concluded that there was lack of evidence to enable the suspect to be charged under Section 12 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007 (Act 670) for human trafficking nor under Section 420 of the Penal Code (Act 574) for cheating and dishonestly inducing delivery of property," the department stated.
As such the AGC stressed that the decision made by its deputy public prosecutor (DPP) was made carefully and with due consideration to the submitted investigation papers and documents.
The AGC also stressed that it is always committed to ensure that any parties who commit crime will face justice should there be sufficient evidence.
The response came, after theSun had embarked on a sting operation with the police to uncover an organ trafficking syndicate five months ago.
The operation took off several months after our reporter had monitored a Facebook page, ostensibly dedicated to the sale of human organs for transplants.
This resulted in the identification of a group who allegedly preyed on vulnerable families of the sick, who were desperately looking to buy organs to save their loved ones – without any intention to deliver.
Initial investigations had revealed that the suspect and his accomplices were allegedly involved in an elaborate con to fleece people in desperate need of organ transplants.
However, despite the police having completed their investigations and referring the investigation papers to the DPP for advice and direction, the DPP had declared that there was no case.
