Prosecution fails to transfer case involving Sri Lanka High Commissioner to KL court

KUALA LUMPUR: The High Court here today dismissed an application by the prosecution to transfer the case of three men charged with causing hurt to Sri Lanka High Commissioner in Malaysia Ibrahim Sahib Ansar to the Kuala Lumpur Sessions Court.
As such, the three accused - A. Kalaimughilan, 25, V. Balamurugan, 34, and V. Ragunathan, 38, – will be tried at the Sepang Sessions Court.
The prosecution had applied to transfer the case fearing for the safety of the high commissioner who is a prosecution witness in the case.
Judge Datuk Nordin Hassan dismissed the application on grounds that the excuse given by the prosecution was unreasonable.
"There is no reasonable ground for court to transfer the case. If the victim is not satisfied, he can complain to the authority or the police and the Sessions Court in Sepang. I dismiss the application," he said.
Nordin made the decision after hearing submission by deputy public prosecutor Ezrene Zakariah and counsel M. Manoharan, who represented the three accused.
The three men, together with four others still at large, were charged on Sept 9 last year with causing hurt to the high commissioner at Level 3 of the KL International Airport (KLIA) in Sepang, Selangor, at 3pm on Sept 4 , 2016.
Kalaimughilan and Ragunathan, who are businessmen, and Balamurugan, a taxi driver, were charged under Section 147 of the Penal Code and face an imprisonment for up to two years, or fine, or, both, if found guilty. — Bernama
