KUALA LUMPUR: A 21-year-old food stall assistant was jailed for 13-years by the High Court, after he admitted to three terror related offences, including giving support to Islamic State (IS) terrorism activity, which involved the use of explosive materials.
High Court judge Datuk Nordin Hassan jailed Azizi Abdullah for 13-years on the first charge of giving support to terrorism, involving the use of explosive material, through the "telegram" application in his handphone.
The offence under section 130J (1)(b) of the Penal Code was committed at F15, Kg Baru Lubok Buntar, Serdang, between March 25, 2016 and June 29, 2016.
Azizi was jailed four years more for the possession of items, related to IS and another four years for the possession of images related to IS in his handphone, at about 12pm on June 29, last year.
Nordin ordered all the sentences to run concurrently, from the date of his arrest, June 29, 2016.
Azizi, in his mitigation said he regretted his act, asked for a lower sentence and for the sentences to run concurrently.
According to the facts of the case, Azizi, who is a member of a "Telegram" group called "Gagak Hitam" (black crow) and "Amanah vs PAS" was active in communication and had supported IS, between March 25, 2016 and June 29, 2016.
The accused's statements in the groups had the elements of threat and also encouraged attacks on the police, and bomb attack and armed attack.
After the attack on the Movida Club, the accused had posted "Alhamdulillah" in the "Amanah vs Pas" telegram group. The police also found a flag, which was modified by Azizi himself into the "IS" flag.
Deputy Public Prosecutor Azlina Rasdi said the accused had said "Alhamdulillah" after the Movida attack and said the court must take into the consideration the nature and the seriousness of the action of the accused, who supported terrorism activity.
She said the facts of the case showed that the accused is a strong supporter to IS group and asked for a sentence, which could serve as a lesson to the accused and as a 'warning" to others.
