KUCHING: The Sarawak DAP Committee emergency meeting chaired by its chairman Chong Chieng Jen (pix) has unanimously agreed to file a court action to challenge and quash the decision of the Sarawak State Assembly in disqualifying Dr Ting Tiong Choon as Pujut state assemblyman.
"It is the state committee's unanimous decision that we file legal action against the State Assembly, Speaker and the relevant parties to quash the decision," he told a press conference after the meeting here today.
Chong said the committee viewed the motion and resolution taken by the State Assembly as an assault on the fundamental democratic principles upon which the country was founded.
"It is not only a case involving Dr Ting or DAP elected representatives but this a case to defend the basic fundamental structure of our constitution, in particular the principle separation of powers," he said, adding that he would file a writ of summons within a month.
To a question on the by-election, Chong who is also Kota Sentosa assemblyman said it was up to the Election Commission to hold it, adding that DAP would field its candidate to defend the seat.
