BUTTERWORTH: Five doctors and two insurance agents faced cheating charges today for attempting to deceive the Road Transport Department (RTD) over mandatory physical health examinations for vocational driving licence applicants on Feb 14 this year.
They were accused of attempting to get the RTD to process vocational licences for certain individuals by falsely claiming they had duly undergone physical health examination, which the RTD would not do if it was not deceived.
In the Butterworth Sessions Court, Dr Ding Yong Chaung, 73, pleaded guilty to committing the offence at Ding Polyklinik Dan Surgeri in Bukit Mertajam here at about 11.45am.
Ding admitted trying to deceive the RTD into believing he had conducted a physical health examination on one Mohd Firdaues Azizan, 34, for the purpose of renewing his vocational licence, formerly known as a Public Service Vehicle (PSV) licence.
The offence under the Penal Code, read together with Section 28 (1) (a) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, is punishable with up to five years' jail or a fine, or both.
Ding, who was unrepresented, requested for a lower bail due to his age and that he suffered from high blood pressure, diabetes and kidney failure.
Sessions Court Judge Noor Aini Yusof fixed RM8,000 bail in one surety and set June 13 for sentencing.
Outside the court, Ding tried to stop media photographers from taking his picture by putting up his arms and lunging at them.
"Don't you all have work to do?" he shouted several times at media personnel.
Meanwhile, four other doctors claimed trial to similar charges preferred against them by the MACC in the Butterworth and Georgetown Sessions Courts. They were:
>> Dr Lufti Mohamad Rashidi, 32, who was charged in the same court as Ding for committing the offence in relation to a physical health examination on Mohd Firdaues at Klinik Rashidi in Bukit Mertajam here about 12.20am on Feb 14 this year.
Noor Aini, who fixed bail at RM8,000 in one surety and set July 4 for mention, ordered Lufti to report to the MACC office once a month.
>> Dr Kamal Fasha Hussain, 55, who was charged before Judge Norsalha Hamzah in the Georgetown Sessions Court with committing a similar offence in relation to the physical health examination of one Hasrol Hissam Osman, at Polilklinik Perdana in Jalan Sungai Dua here at about 11.30am that day.
>> Dr See Teik Guan, 49, who was accused before Norsalha of committing the offence in relation to a physical health examination on Mohd Firdaues at Poliklinik See in Batu Ferringhi here about 2.25pm that day.
>> Dr S. P. Samuel Kumar, 58, who was charged in Ipoh before Sessions Court judge S. Indra Nehru, with with committing a similar offence in relation to the physical health examination on two lorry drivers at his clinic in Pekan Lama Parit Buntar, Kerian between 10.15am and 3.40pm.
Indra Nehru set bail at RM12,000 for both charges and June 14 for mention.
Meanwhile, two insurance agents Lim Geok Huat, 54, and Chan Ah Kow, 57, claimed trial before Norsalha to a charge of using as genuine, a vocational licence application certified by a doctor despite having reason to believe the document was fake.
Both were alleged to have committed the offence at the Batu Uban RTD branch in Jalan Sultan Azlan Shah here between 11.45am and 12pm that day.
The offence for using as genuine a forged document is punishable under the Penal Code with up to two years' jail or a fine, or both.
Norsalha set bail at RM6,000 each for Kamal Fasha, See, Lim and Chan, and fixed July 14 for mention for all four cases.
DPP Ahmad Ghazali Muhamd Nadzri prosecuted while Kamal Fasha and See were represented by Jason Khor, Lim by C. P. Ang and Chan by R. S. N. Rayer.
