Court strikes out Jamal's suit against Selangor govt, two others

PETALING JAYA: The Kuala Lumpur Sessions court has struck out Sungai Besar Umno division chief Datuk Seri Jamal Md Yunos' (pix) suit against the Selangor government and two other parties over the closure of his resort in Sekinchan.
Sessions judge Syed Faisal Syed Amir said Jamal who is the director of Linear Active Sdn Bhd, the company under which the suit was filed, had fail to reveal the cause of action in the law suit.
In his judgment, Syed Faisal described the failure to reveal the cause of action as scandalous, frivolous, vexatious and an abuse of the court process.
He then ordered Jamal to pay RM6,000 in costs to all three defendants.
Syed Faisal also deemed the decision by the Sabak Bernam District Council in sealing and ordering for the closure of Sekin Fisherman Village Hotel & Resort (Sekin Resort) and the Sabak Bernam Land and District Office's act to demolish the resort which was built on a government reserve land on Dec 22, last year as valid.
Linear Active was represented by counsel V. Mugunthan while counsel Hashim Ibrahim represented MDSB and Selangor legal advisor Khairul Nizam Mohd Kamal acted for the Land and District Office and the Selangor government.
Filing the suit on December 28, last year, Jamal claimed the move by the defendants was a retaliatory act after he held a protest in front of the Sultan Salahuddin Abdul Aziz Shah building in Shah Alam over the water disruption that affected over 3.8 million users in Klang Valley on December 21, last year.
Jamal who is also the Red Shirts leader had sought an injunction to stop the defendants from demolishing the premises and another injunction to prevent them from stopping its operations.
He also sought for RM140,000 damages following the disturbance caused by the authorities and damages for the demolition.
In response earlier, the Selangor government had stated that the building was demolished because it did not have a local council permit.
