KUALA LUMPUR: An assistant cook was jailed six years for giving support to the Islamic State (IS) terrorist group through the "Black Crow" telegram application, where IS leader Muhammad Wanndy Mohamed Jedi is the "Admin" (administrator).
High Court judge Datuk Indera Mohd Sofian Tan Sri Abd Razak jailed Rosmizam Che Din, 29, for another two years on another charge of possessing pictures and videos related to the terrorist group, in his handphone.
However, the judge ordered Rosmizam to serve his sentences concurrently, from the date of his arrest, July 15, 2016. The accused will only serve six years in jail.
In the first charge, Rosmizam admitted giving support to IS through the "Black Crow" telegram group, by using the name "Zam Rosden Di" at No.73, Jalan USJ 6/3B Subang, at about 12.33am on March 30, 2016.
In the second charge, Rosmizam admitted possessing 34 pictures and two videos, at a car park at LG level, at a supermarket, Persiaran Subang Permai, Subang Jaya at about 1.30pm on July 15, 2016.
According to the facts of the case, Rosmizam had pledged loyalty (Bai'ah) in the telegram group on March 30, 2016. The telegram group, which was created by Muhammad Wanndy and served as the "Admin" had pledged loyalty (Bai'ah) to IS.
In his decision, Mohd Sofian said the offence is serious and it could affect the stability and peace of a nation.
"By pledging "Bai'ah" (loyalty) in the telegram group shows that you are willing to do anything to achieve your ambition. (It means) you are willing to die to realise (achieve) your goal," said the judge.
He added if such offences was not controlled, the accused could have been one of those, who would be willing to die or "jihad".
He said pledging "bai'ah" is an offence under the law. "The court hopes that you will truly repent and regret as stated by your counsel," said Mohd Sofian.
Rosmizam's lawyer Mohd Yusoff AG.Lah said his client earns RM1,500 a month, is unmarried, lives with his mother, who is 65 years old and is the sole breadwinner. "The accused had regretted his act and had repented and promises not to commit any offences, in the future," said Mohd Yusoff.
He said the accused has no previous conviction and appealed to the court to give the accused a chance. He pleaded for a short term jail sentence and for the sentences to run concurrently from the date of arrest.
Mohd Yusoff said the accused was "added" into the group and never knew the "Admin" Muhammad Wanndy.
