KUALA LUMPUR: The High Court here today acquitted and discharged an unemployed man on a charge of trafficking in 1,118.59g of cannabis and 162.9g of Methamphetamine last year without calling for his defence.
Judicial Commissioner Datuk Mohamad Shariff Abu Samah also acquitted T.Buvaneswaran, 28, for possession of 1.22g of heroin.
He ordered Buvaneswaran to be freed after finding that the prosecution had failed to prove a prima facie case against the accused and also of contradictions in the testimony by the prosecution witnesses.
"In applying the principles of law on all the evidence at the end of the prosecution case, I'm not prepared to convict the accused.
"Therefore, this court acquits and discharge the accused with immediate effect on all three charges," he said.
Buvaneswaran was alleged to have committed the offences at an unnumbered house at Flat Dewan Bandaraya Kuala Lumpur (DBKL), Bangsar here at 12.30am on Sept 8, 2016.
He was represented by lawyer, S.Narasimhan, while deputy public prosecutor  Ahmad Nazneen Zulkifli prosecuted. — Bernama
