Court sets Oct 19 for re-mention of robbery, rape case of nursery teachers

KUALA LUMPUR: The Ampang Sessions Court has fixed Oct 19 for a re-mention of a case involving two friends charged with committing armed robbery, rape and unnatural sex on two nursery teachers in July.
Judges Syafeera Mohd Said and Azrul Darus fixed the date after the case, which went viral on the social media, was mentioned in their presence in the proceedings at the re-mention of the case for submission of the documents here today.
Earlier, Deputy Public Prosecutor Nadiah Malek Fauzie informed the court that she had not received the documents relating to the case, including the chemistry report.
"The chemistry report has not been sent, many items pertaining to the case such as the victims' clothes, samples from the hospital, items confiscated from the scene such as bedsheets and blankets (toto). We request for time," said Nadiah.
Counsel Azra Kamarudin who represented both the accused did not protest.
On Aug 7, Erza Iwan Ni @ Nirman, 34, and Aza Nizam Abd Razak, 40, both car re-possessors pleaded not guilty at two separate Sessions Courts on the charge of committing armed robbery, rape and unnatural sex on two nursery teachers.
Erza Iwan and Aza Nizam were charged with jointly committing armed gang robbery on the two victims, aged 20 years nine months and 18 years nine months, and robbing them of handphones, a television set, handphone batteries and RM300 in cash, all amounting to RM1,320.
The incident occurred in the bedroom on the first floor of a nursery in Pandan Indah here at 4.30am on July 14.
The two men were charged under Section 395/397 of the Penal Code which carries a jail sentence of up to 20 years and caning, if found guilty.
They were also charged with raping the two victims at the same place, time and date under Section 376(1) of the Penal Code which provides for a jail sentence of up to 20 years and caning, if found guilty.
Erza Iwan was also charged with using criminal force by committing unnatural sex on the older victim without her consent at the same place, time and date under Section 377C of the Penal Code which provides for a prison sentence of up to 20 years and caning, if found guilty. — Bernama
