PETALING JAYA: A contractor was fined RM4,000 for posting a false comment on Facebook about a traffic summons being issued over a sunshade.
Magistrate Salamiah Salleh imposed the fine on Lee How Kim, 26, in default, four months jail, after he pleaded guilty to the charge.
The offence was committed at No.70, Jalan PUJ 9, Bandar Putera Permai, Seri Kembangan on Sept 6.
The charge under Section 233(1)(a) of the Communications and Multimedia Act 1998 is punishable by a fine of not more than RM50,000, or a jail term of not more than one year or both.
During mitigation, Lee's lawyer Kee Wei Lon said his client's guilty plea had saved the court's time. He said Lee took the first opportunity to admit to the charge and this showed his remorse.
Deputy Public Prosecutor Mary Phoon Keat Mee asked the court to mete out an appropriate sentence.
She said the sentence should serve as a deterrent on posting false information on Facebook.
According to the facts of the case, Lee, who was driving a Toyota Hilux, was stopped by a traffic policeman during a roadblock operation at Serdang Perdana.
An examination of the vehicle revealed that the tint on the windows were not in compliance with the Road Transport Department (RTD) regulations.
The officer subsequently issued a summons to the accused.
Following the incident, Lee posted on Facebook that he was issued a traffic summons over the use of a sunshade for the vehicle.
