IGP's application to dismiss Jamal's subpoena to be decided Nov 14

KUALA LUMPUR: The High Court has fixed Nov 14 to decide on an application by Inspector-General of Police Tan Sri Mohamad Fuzi Harun to dismiss a subpoena served by Sungai Besar UMNO chief Datuk Seri Jamal Md Yunos in a civil suit involving activist Maria Chin Abdullah.
Jamal submitted the subpoena to Mohamad Fuzi to appear as a witness in a defamation suit filed by Chin against the former for allegedly linking Bersih 2.0 with terrorist group Daesh.
Judge Datuk Mohd Zaki Abdul Wahab fixed the date in his chambers after hearing arguments from senior federal counsel Ahmad Terrirudin Mohd Salleh, who represented Mohamad Fuzi, and lawyer V. Mugunthan, representing Jamal.
Ahmad Terrirudin, when met by reporters said he had argued that Chin's arrest had nothing to do with Mohamad Fuzi, who was formerly Special Branch director.
Meanwhile, Mugunthan argued that Mohamad Fuzi was a credible witness as he was the Special Branch director at that time, and should have known why Chin was detained under the Security Offences (Special Measures) Act 2012 (Sosma).
The proceeding was also attended by Chin's counsel, Shahid Adli Kamarudin.
In addition to Mohamad Fuzi, Jamal also served subpoenas to former prime minister Tun Dr Mahathir Mohamad, former inspector-general of police Tan Sri Khalid Abu Bakar and Kuala Selangor police chief Supt Ruslan Abdullah.
Jamal will also call on opposition activist Hishamuddin Md Rais, and serve a subpoena to lawyer Hasan Karim, who had been a student activist in the 1970s, as the head of the University of Malaya Socialist Club.
On Oct 7 last year, Chin, 60, who is also Clean and Fair Elections Steering Committee (Bersih 2.0) chairman, sued Jamal, who is the chairman of Malay Non-Governmental Organisation Coalition and Gagasan Merah Malaysia.
In her statement of claim, she said that on Sept 28, last year, Jamal had uttered defamatory words in a media conference in the vicinity of the Putra World Trade Centre which was subsequently published and broadcast on several news portals, national print and electronic media.
The plaintiff also claimed that on Oct 4 last year, Jamal once again uttered defamatory words against her at the Bukit Aman federal police headquarters, and it was published on Oct 5 on news portals, national print and electronic media.
Chin demanded compensation for general, severe, and exemplary damages and an injunction order to prevent the defendant from repeating or rebroadcasting the defamatory words. — Bernama
