High Court dismisses prosecution's appeal, Ku Chin Wah remains free (Updated)

KUALA LUMPUR: Former Kuala Lumpur Criminal Investigation Department (CID) chief SAC Datuk Ku Chin Wah remains a free man after the High Court here upheld his acquittal over allegations of failing to declare all his sources of income four years ago.
The decision was made by High Court judge Justice Azman Abdullah after dismissing an appeal by the prosecution against a Sessions Court decision that acquitted and discharged Ku, 59, in May.
DPPs Awang Armadajaya Awang Mahmud and Budiman Lutfi appeared for the prosecution while Ku was represented by lawyer Datuk Geethan Ram Vincent.
On May 26, a Sessions Court here acquitted and discharged Ku after finding the defence had proven reasonable doubt at the end of the defence case.
Ku was accused of having failed to declare all sources of income in his sworn statement dated Jan 8, 2014, and was charged under Section 49(3) of the Act.
The offence was allegedly committed at the Malaysian Anti-Corruption Commission headquarters in Putrajaya between Dec 23, 2013, and Jan 21, 2014.
