Two men charged for sending obscene SMS to woman

SEREMBAN: Two men were charged in the Sessions Court here today with a total of 10 counts of improper use of network service for sending obscene short messages through the short messaging service (SMS) to a woman about three years ago.
Nor Zeland Ithnin, 57, and Othman Kadir, 58, pleaded not guilty and claimed trial to all the charges which were read out separately before judge Ahmad Fairuz Mohd Puzi.
Nor Ithnin, a health assistant at a clinic in Pahang, was charged with seven counts of committing the offence with the intention of annoying others at Bandar Baharu Sunggala, Port Dickson near here, between 5.26am and 9.20am from Aug 16 to 19, 2014.
Meanwhile, Othman, a health assistant at a clinic in Melaka, was charged with three counts of committing a similar offence on the same woman at Bandar Baharu Sunggala, Port Dickson near here between Aug 6 and 7, 2014, from 12.29pm until 4.03am.
They were charged under Section 233(1)(a) of the Communications and Multimedia Act and faced a fine not exceeding RM50,000, or to imprisonment for up to one year, or to both, and shall also be liable to a further fine of RM1,000 for every day during which the offence is continued after conviction.
Ahmad Fairuz then set bail of RM1,500 with one surety for all charges on Nor Zeland and RM1,000 with one surety for all charges against Othman.
The court set Dec 27 for the appointment of counsel and submission of documents.
