PETALING JAYA: WCT Holdings Bhd’s indirect wholly owned subsidiary Gemilang Waras Sdn Bhd has filed its counterclaim against Aeon Co (M) Bhd by way of a notice of application claiming for vacant possession of the Bandar Bukit Tinggi Shopping Centre (the leased property) to be delivered to Gemilang Waras as well as damages to be paid by Aeon to Gemilang Waras.
WCT said the damages are to be paid to Gemilang Waras in the form of double rental in the amount of RM4.84 million per month (calculated on the basis of a monthly rental of RM2.42 million) according to Section 28(4) of the Civil Law Act 1956.
Alternatively, it called for damages to be assessed, calculated from Nov 23, 2017 until the date vacant possession of the leased property is delivered to Gemilang Waras.

“The company will make further announcement of any material development arising from the above proceeding as and when necessary,” said WCT.
Last month, Aeon had filed a suit against Gemilang Waras to renew its lease for Aeon Mall Bukit Tinggi.
Aeon is seeking court intervention to stop Gemilang Waras and those tied to the company from terminating the lease agreement dated Nov 23, 2007 and from trying to evict the company or its tenants from Aeon Mall Bukit Tinggi, pending the court’s decision.
WCT closed 1.31% lower at RM1.51 today with 2.69 million shares traded. Aeon closed unchanged at RM1.85 with 1.16 million shares traded.
