Daesh support: Appeal Court upholds sentence on ex-assistant cook

PUTRAJAYA: The Court of Appeal has upheld the six-year jail sentence on a former assistant cook for supporting terrorism and possession of images and videos of the Daesh militant group last year.
Judge Datuk Wira Mohtarudin Baki who headed the three-man bench made the decision on Rosmizam Che Din after dismissing the appeal by the prosecution against the sentence imposed by the High Court on July 12 this year.
The panel of judges including Datuk Ahmadi Asnawi and Datuk Kamardin Hashim found the prosecution's appeal against the initial sentences had no merit.
As such the decision of High Court judge Datuk Sofian Abd Razak, who sentenced Rosmizam to six years imprisonment on the charge of supporting Daesh militant group and two years' jail for possessing the group's images and videos was maintained.
However, the accused was only required to serve six years' prison sentence as the court ordered the sentences to run concurrently from the date of arrest on July 15, 2016.
Rosmizam as the respondent was charged with providing support to the militant group through a telegram app in the 'Gagak Hitam' chat group under the name of 'Zam Rosden Di' by using his telephone number at No. 73 Jalan USJ6/3B, Subang here at 12.33am on March 30, 2016.
The charge under Section 130J (1) (a) of the Penal Code provides for life imprisonment, or for up to 30 years, or fine, and forfeiture of any property used or intended to be used in connection with the commission of the offense, if found guilty.
Rosmizam was also charged with possessing 34 images and two videos on the militant group in his mobile phone at the LG parking lot of Da'Men Supermarket, Subang Permai, Subang Jaya here at 1.30pm on July 15, 2016.
The charge under Section 130JB (1) (a) of the same law carries a maximum jail term of seven years or a fine and shall also be liable to forfeiture of any such item.
Rosmizam, who was unrepresented in mitigation appealed to the court to retain the prison sentence handed down to him as he was remorseful and wanted to start a new life after being released.
The accused who is single and has no previous convictions is expected to be released in 2020.
