KUALA LUMPUR: A Kuala Lumpur City Hall (DBKL) enforcement personnel was fined RM2,000 in default six months imprisonment by the Ampang Magistrate's Court here for participating in a fracas at a condominium.
Mohd Neezam Jelani, 35, had initially claimed trial to the charge but changed his plea to guilty when the case was brought for remention today.
Earlier, deputy public prosecutor (DPP) Norhashimah Hashim told Magistrate Mohamad Firdaus Sadina Ali that the Attorney-General's Chambers had rejected the accused's representation to drop the charge against him.
Mohd Neezam committed the offence with two others still at large, in the vicinity of the guardhouse at Kondominium Puncak Athenaeum, Bukit Antarabangsa here, at 2.30pm on Jan 14. A lorry driver was injured in the incident.
The charge under Section 147 of the Penal Code carries two years maximum jail or a fine, or both, on conviction.
According to the facts of the case, the incident happened when a lorry with two men rammed the rear of a car belonging to Mohd Neezam's friend, which was parked at the roadside near the condominium.
The car owner became angry and a quarrel ensued with Mohd Neezam joining in the fracas that ended with the lorry driver being assaulted.
In mitigation, counsel Siti Suraya Abu Hassan said it was the accused's first offence, and he also had to support a wife and three children aged between three months and eight years.
However, the DPP urged the court to impose an appropriate sentence "as a lesson to the accused". — Bernama
