Court dismisses claims against Milux Corp

    PETALING JAYA: The Shah Alam sessions court has dismissed claims filed by Foh Kah Heng Trading (FKH) against Milux Corp Bhd’s wholly owned subsidiary Pansprint Consolidated Sdn Bhd, in relation to a payment dispute for a sub-contract mining agreement.
    Milux’s board of directors said in a Bursa Malaysia filing, the court had ruled against FKH as it failed to prove its claims on the “balance of probability”. A full trial was held on Dec 29.
    The claims surrounded an agreement entered between the two parties on Feb 22, 2012, where Pansprint had appointed FKH, as a sub-contractor, to extract, remove, transport and process iron ore deposits.
    Milux’s board said in a filing in July 2016, that it had been served with writ of summons and statement of claim by FKH where the latter demanded a sum of RM324,495.60 and cost of notice of RM100 to be paid within two weeks from the date of the summons.
    The sum demanded was for two bills issued by FKH dated 15 April 2013 and 27 June 2013, after the completion of mining works.
    FKH also claimed for a 5% interest rate will be charged annually on top of the sum of RM324,495.60 between the date of Writ of Summon until the date of full settlement.
