48 Segamat voters get go ahead for judicial review

KUALA LUMPUR: The High Court today allowed 48 registered voters in Segamat parliamentary constituency to obtain a judicial review on the suspension of entry of 949 names into the 2017 Third Quarter Supplementary Electoral Roll.
Judge Datin Azizah Nawawi made the decision after rejecting the initial objection raised by the Election Commission (EC) on the grounds that there was a special circumstance for the court to hear the case.
Senior Federal Counsel Shamsul Bolhassan, for the EC, told reporters after the proceedings in chambers which was also attended by lawyer Michelle Ng, who acted on behalf of the 48 registered voters.
The court set Jan 16 for case management of Abdul Wahab Hassan and 47 registered voters who filed the application on Dec 14, 2017, and named the EC and the Johor voter registrar Shafie Taib as the first and the second respondents.
The 48 voters applied for a certiorari order to revoke the entry and / or retain the 949 names with any action arising out of and / or verify the decision by the respondents and / or agents and / or employees and / or their officers.
They also applied for a declaration that the entry and / or retention of 949 names were unconstitutional because they did not meet the requirements of Article 119 of the Federal Constitution.
The voters claimed that the entry and / or retention of the names of Persons Denied was unreasonable, irrational and unbalanced. — Bernama
