Seven years' jail, whipping for robbing and hurting woman

KUALA LUMPUR: A former dispatch rider was sentenced to seven years' jail and three strokes of the cane by the Ampang Sessions Court today for voluntarily causing hurt to a female parking supervisor of Zoo Negara while robbing her of a mobile phone in September last year.
Judge Azrul Darus meted out the sentence on Wan Ahmad Kamil Wan Daud, 37, who is currently unemployed, after he changed his plea to guilty on the third day of the trial.
The court ordered Wan Ahmad Kamil to serve his sentence from the day he was arrested, Sept 5, 2017.
Wan Ahmad Kamil was charged with committing the offence on Koo Kah Lai, 29, at a parking area in front of the Finas building, Taman Melawati, Ampang Jaya, here, at 11.30am on Sept 3, 2017.
The charge under Section 394 of the Penal Code carries a jail term of up to 20 years with whipping or a fine, upon conviction.
According to the facts of the case, on the day of the incident, the victim who was at the Zoo Negara parking lot saw the accused, who was wearing a safety vest, outside the Finas parking area.
The complainant then approached the accused upon seeing him instructing someone to park his car at the Finas parking lot before telling Wan Ahmad Kamil that what he did was wrong and she would report the matter to Finas.
The accused, however, scolded the victim and told her not to interfere. The victim then tried to take the accused's photo with her mobile phone but failed after the man snatched the phone and punched her on the right cheek, causing her to fall.
The victim then asked the accused to give her back the mobile phone, but he refused and kicked the woman on her right thigh before fleeing with the phone.
In mitigation, the accused who was unrepresented, pleaded for a light sentence on grounds that he had to support his unemployed wife, who was suffering from a nerve disorder, and three children.
Deputy public prosecutor Nadiah Malek Fauzie urged the court to impose a deterrent sentence, taking into account the violent act committed by the accused which had caused injuries to the victim. — Bernama
