Bus driver admits using forged circular resolution

KUANTAN: The sessions court here today sentenced a bus driver to one day in prison and RM10,000 fine or another six months' jail for using a forged document to transfer ownership of a bus, three years ago.
M. Indran, 32, from Klang Selangor, pleaded guilty before judge Dazuki Ali to using a fake circular resolution belonging to Gift Two K Holidays Sdn Bhd dated April 15, 2014, purportedly allowing him to buy a Mercedes Benz bus from the company for RM45,000.
He committed the offence at the Road Transport Department (JPJ), Raub office on May 20, 2014, as charged under Section 471 of the Penal Code, punishable under Section 465 of the same code which carries a maximum imprisonment of two years or a fine, or both, on conviction.
Counsel Mohd Hamizi Mat Said in mitigation said it was his client's first offence and by pleading guilty, had saved time and cost for the court and other parties.
"He only earns around RM1,200 and has to support his mother who lives with him. He is remorseful for his action and had given his full cooperation since his arrest on Jan 16," submitted counsel.
However, deputy public prosecutor Mohamad Fadly Mohd Zamri from the Malaysian Anti-Corruption Commission urged the court to impose a heavy sentence as Indran's action had resulted in a loss for the company.
According to the facts of the case, the company's owner, Che Ahmad Che Long, had leased the Mercedes Benz bus worth RM376,000 to Indran for RM5,000 a month, but the latter stopped paying after one year.
Che Ahmad received a summons from the Tourism Ministry's licensing division in Kedah which became suspicious as to why the bus did not have a tour driver and lodged a police report.
A verification with JPJ confirmed that ownership of the bus was transferred to Indran in 2014.
Indran settled the fine. — Bernama
