Pakistani private university student freed of drug charge

SHAH ALAM: The High Court today released and freed a private university student of Pakistani nationality from a charge of trafficking cannabis, weighing 3,956g, two years ago without being called to defend himself.
Judicial Commissioner S. M. Komathy made the decision after the prosecution failed to prove a prima facie case against the charge faced by Mohammed Zohaib Khan, 27.
A total of four prosecution witnesses were called to testify during the two-day trial from Jan 22.
Mohammed Zohaib was accused of trafficking the cannabis at Jalan SS14/8E, SS14, Subang Jaya near here at about 3 pm on Aug 4, 2016. The drug was found inside the boot of a car he was in.
The charge against him was framed under Section 39B (1) (a) of the Dangerous Drugs Act 1952 and liable to face the mandatory death penalty upon conviction under Section 39B (2) of the same act.
Mohammed Zohaib was represented by counsel Datuk N. Sivananthan and Lam Kah Kah while deputy public prosecutor Aidatul Azura Zainal Abidin appeared for the prosecution. — Bernama
