Three family members charged with selling falsely labelled infant formula

JOHOR BARU: Three family members were charged in the Sessions Court here today with selling infant formula with false trade description last year.
Yap Kai Chai, 59, faced three charges, one where he was jointly charged with his sister-in-law, Ling Mei Nar, 42, and two charges with his son, Yap Chang Hong, 26.
All of them pleaded guilty to the charges before judge Jailani Rahman.
Kai Chai and Ling, who are partners of TCM Yongtai Lian business, were charged with selling the infant formula using a false trade description Enfalac A+ Step 1 (1.8kg) as if the items were of the registered trademark "Enfalac".
The were alleged to have committed the offence at a TCM Yongtai Lian outlet at Jalan Utama 34, Taman Mutiara Rini, Skudai, at about 1pm on Dec 7 last year.
On the second count, Kai Chai and Chang Hong, who are partners in the Yong Thye Lian medicinal business herb, were charged with committing the same offence at at their shop at Jalan Bestari 4/2, Taman Nusa Bestari Skudai, at about 2pm on the same day.
The charges against them were made under section 8(2)(b) of the Trade Descriptions Act 2011 and punishable to a fine of up to RM10,000 for each good bearing the false trade description, or imprisonment for up to three years, or both, if found guilty.
On the third count, Kai Chai and his son were charged under Section 8 (2) (c) of the same law with having in their custody for supply of the 208 units of the infant formula with the false description at a premises in Jalan Orkid 17, Taman Seri Orkid, at 4.40pm on the same day.
Jailani set March 23 for mention.
