KUALA LUMPUR: The Malaysian Communications and Multimedia Commission (MCMC) and Nuemera Sdn Bhd, a data security company have been asked to file their defence over a data leak case involving 46.2 million telco subscribers.
The Session Courts today instructed MCMC and Nuemera to file their defence against the civil suit brought by PKR communications director Fahmi Fadzil.
Lawyer Louis Liew who represented Fahmi told reporters that Sessions Judge Harmi Thamri Mohamed had set March 22 for case management.
The plaintiff (Fahmi) found out about the data leak and that his details were part of it on Oct 2017 after a few websites and news portals revealed the leak.
Fahmi is seeking general damages, costs and other relief deemed fit by the court in the suit that was filed on Feb 6 this year.
In his suit, Fahmi claimed that Nuemera was appointed by MCMC to provide public cellular blocking service (PCBS) in 2014, a service that allows cellphone users to deactivate their mobile line services within three hours after the phone is reported stolen.
In a press conference last month, Fahmi said he is seeking answers as to what MCMC and Nuemera have done to avoid further breaches, and how the breach had occurred.
"This is why, as a telco user affected by the breach and because it is a matter of public interest, I have decided to take legal action against MCMC and Nuemera, for their failure to secure our private information," he said during the press conference at PKR's Lembah Pantai office.
The breach is said to have happened between 2012 and 2015, affecting Jobstreet.com, the Malaysian Medical Association, Malaysian Medical Council, Academy of Medicine Malaysia, Malaysian Dental Association, National Specialist Register of Malaysia and telecommunications companies, including Maxis, Celcom and Digi.
