Pua fails to reinstate 1MDB misfeasance suit against PM, government

PUTRAJAYA: DAP national publicity secretary Tony Pua Kiam Wee today failed to convince the court to reinstate his lawsuit against caretaker Prime Minister Datuk Seri Najib Abdul Razak and the government for alleged misfeasance in the management of 1Malaysia Development Berhad (1MDB) funds.
The Court of Appeal comprising Datuk Ahmadi Asnawi, Datuk Kamardin Hashim and Datuk Yeoh Wee Siam held that there was no merit in Pua's appeal.
"No appealable error to warrant our intervention," Ahmadi who led the bench said, adding, the court agreed with the findings of the High Court.
Pua who was Petaling Jaya Utara MP prior to the dissolution of parliament was ordered to pay RM5,000 costs each to Najib and the government.
He sued Najib and the government on Jan 16, 2017.
On Feb 14, 2017, Najib applied to strike out the suit on grounds that Pua was not a public official and had abused the court process. On March 2, the government filed a similar application on the contention that Pua had no locus standi to institute legal proceedings against it.
On Oct 13, the High Court dismissed the suit ruling that Pua, who is also Selangor DAP chairman, had no locus standi to file it.
Lawyer Michelle Ng represented Pua, while Tan Sri Cecil Abraham represented Najib. Senior federal counsel Alice Loke Yee Ching appeared for the government. — Bernama
