Gabungan AQRS sues several parties over contract breach

    PETALING JAYA: Gabungan AQRS Bhd's two subsidiaries are suing several parties for alleged breach of contract in relation to the provision of accommodation on base-camp concept complete with necessary facilities for Petronas Chemicals Fertiliser Sabah Sdn Bhd.
    The group is also working towards getting both suits heard at the same time at the Kota Kinabalu High Court.
    Gabungan AQRS told the stock exchange that its subsidiaries Trusvest Sdn Bhd and Gabungan Strategik Sdn Bhd have commenced proceedings for the two similar cases at the High Court of Kota Kinabalu on March 29 and May 17 respectively.
    Trusvest (first suit) is suing defendants Seri Wilayah Engineering Sdn Bhd, REMT Utama Sdn Bhd, Norahmad Yussuff, Azhar Khan Badil Zaman, Gabungan Strategik Sdn Bhd, Syarikat Muhibah Perniagaan & Pembinaan Sdn Bhd and Imaprima Sdn Bhd for alleged breach of contract.
    Trusvest has also pleaded various causes of actions against the defendants, including inducing breach of contract, breach of statutory and fiduciary duties, fraud, collusion, and conspiracy.
    The second suit is in relation to the same line of dispute as in the first suit, where the first suit concerns dispute between the main contractors, the second suit concerns disputes on the lower part of the chain i.e. the sub-contractors.
    The second suit filed by Gabungan Strategik against Imaprima Sdn Bhd, Syarikat Muhibah Perniagaan and Pembinaan Sdn Bhd as well as Seri Wilayah Engineering, REMT Utama Sdn Bhd, Norahmad Yussuff, Azhar Khan Badil Zaman and Shir Zaman Fazul Rahman as defendants.
    On July 16, 2018, the High Court granted order to Trusvest for its interim injunction application. The first suit was then fixed for case management on July 23, 2018.
    The court then further adjourned the case management of the first suit to August 27, 2018 pending filing of any other interlocutory applications.
    "Since the issues in both suits are inter related, parties are working on getting both suits to be heard together in the future. However, as at to date, no case management date has been fixed for the second," said Gabungan AQRS.
    Both suits will most likely be heard together and are currently fixed for case management on August 27, 2018.
    Gabungan AQRS' shares fell 2.07% to RM1.42 with 1.89 million shares done.
