Man files judicial review to stop PD by-election

KUALA LUMPUR: A voter in Port Dickson has filed a judicial review at the High Court, seeking to declare the resignation of incumbent PKR MP Danyal Balagopal Abdullah as unconstitutional.
Rosmadi Mohd Kassim who was represented by lawyer M. Reza Hassan has named Danyal and the Election Commission (EC) as respondents in his application.
He is seeking a court declaration that the notice issued on Sept 20 by the EC to hold the by-election is null and void.
Rosmadi is also seeking an injunction to prevent the by-election from being held, pending the outcome of his application.
Case management has been fixed before High Court judge Datuk Nordin Hassan on Oct 2.
When contacted, Reza said the copies of the court document will be served to Danyal and the EC soon.
The by-election was called following the resignation of Danyal on Sept 12 to pave the way for PKR president-elect Datuk Seri Anwar Ibrahim to contest the seat in his bid to make a political comeback.
Nomination for the by-election is on Sept 29, while polling has been fixed for Oct 13.
In the 14th general election on May 9, Danyal defeated Datuk V. S. Mogan of Barisan Nasional and Mahfuz Roslan of PAS with a majority of 17,710 votes.
