High court upholds sentence on Tian Chua over refusal to heed police order

KUALA LUMPUR: The High Court today upheld the one month's jail and RM1,000 fine imposed on PKR vice-president Tian Chua by the Sessions Court two years ago for refusing a police order to leave the restricted Police Training Centre (Pulapol) in 2012.
Judicial Commissioner Datuk Nordin Hassan passed the judgement after dismissing an appeal by Tian Chua, 53, who is also known as Chua Tian Chang, 53, against the conviction and sentence handed down by the Sessions Court on Jan 23, 2014.
He allowed an application by Tian Chua for a stay of execution of the jail sentence pending appeal to the Court of Appeal.
"Although the Sessions Court judge did not sign the undated written judgment, there has been no miscarriage of justice in accordance with Section 422 of the Criminal Procedure Code," he said.
Tian Chua, the MP for Batu, was found guilty of refusing an order from DSP A. Rajagopal to leave the Pulapol area in Jalan Semarak at 2.30am on April 29, 2012, a day after the Bersih 3.0 rally.
He was represented by counsel Shahid Adli Kamarudin while DPP Nadia Hanim Mohd Tajuddin appeared for the prosecution. — Bernama
