Court to hear cop's bid for more time to file memorandum of appeal on Jan 20

PUTRAJAYA: The Court of Appeal has fixed Jan 20 to hear an application by policeman, Corporal Jenain Subi for extension of time to file his memorandum of appeal in a civil appeal over damages awarded to the family of a teenager who was shot by police.
Lawyer Shahid Adli Kamarudin, representing the 15-year-old teenager's family, said deputy registrar Surya Wati Shawal also set the same day to hold a case management on the matter to fix a date for hearing of the appeal proper of the civil lawsuit.
The police including Jenain and the Malaysian government are appealing against the Shah Alam High Court's decision to order them to pay RM414,800 in damages to Aminulrasyid Amzah's family.
The case management took place in chambers. Also present at the proceeding were senior federal counsel Normastura Ayub, representing the Shah Alam district police chief, former Selangor police chief Tan Sri Khalid Abu Bakar (now the Inspector-General of Police), the Inspector-General of Police and the government, and lawyer Zulkepli Omar who represented Jenain.
Aminulrasyid's mother, Norsiah Mohammad, 67, and eldest sister Nor Azura, 46, sued the police and government, claiming for damages for Aminulrasyid's death, allegedly caused by gunshot wounds to the head of which they claimed was due to Jenain's negligence.
On March 24, this year, the High Court awarded the damages to Aminulrasyid's family after allowing their claim.
Jenain, 53, was charged with causing the death of Aminulrasyid but he was acquitted and discharged by the High Court, and the Court of Appeal upheld the High Court's decision.
Aminulrasyid was shot in a high-speed car chase at about 2am on April 26, 2010. — Bernama
