KUALA LUMPUR: Keadilan communication director, Fahmi Fadzil and a law student, Nalina Nair, withdrew their judicial review filed against Election Commission (EC) over the re-delineation proposal in Setiawangsa constituency.
Outside the court, Fahmi told the media that they have instructed their lawyer to withdraw the review, which was filed on Nov 18, this year.
"This is because, EC through a letter dated Nov 25, 2016 had finally admitted that 110 objection form, which was submitted on Oct 11 had complied with Section 5, Division II, Thirteenth Schedule of the Federal Constitution," said Fahmi.
"EC had finally agreed to hold a local inquiry for Setiawangsa on a date to be fixed later, said Fahmi.
A judicial review was filed by Fahmi and Nalina (on behalf of 110 voters) to review EC's decision to reject objection by the voters, in the Setiawangsa constituency. One hundred and ten voters had submitted their objection over the proposal of the re-delineation exercise.
Lawyer Syahredzan Johan said it is considered as a victory for them. He said if there is a similar situation, whereby voters in other constituency have raised objection but was rejected, they should know they have the right to challenge the EC.
Syahredzan spoke to the media, after he withdrew the suit at the chambers of High Court judicial commissioner Azizul Azmi Adnan.
