Food caterer acquitted of drug trafficking

KUALA LUMPUR: A food caterer escaped the noose today after the High Court here acquitted and discharged him of trafficking in 7.74kg of cannabis without calling for his defence.
Judicial Commissioner Datuk Mohamad Shariff Abu Samah made the decision after finding that the prosecution had failed to establish a prima facie case against Muhammad Fauzan Md Said, 37, at the end of the prosecution case.
In the judgment, Mohamad Shariff said the court found that the prosecution had failed to produce evidence to show that the accused had control and possession of the drug.
The drug was found in a car belonging to the wife of the accused.
"The court therefore acquitted and discharged the accused without calling for his defence," he added.
Muhammad Fauzan was charged with trafficking in the drug at a car park at Block B, Flat Pantai Ria, Pantai Dalam, Brickfields, here at 8pm on Sept 8, 2015.
Deputy public prosecutor Ahmad Nazneen Zulkifli prosecuted, while lawyer Datuk Jagjit Singh Bant Singh represented Muhammad Fauzan. — Bernama
