KUALA LUMPUR: Prime Minister Datuk Seri Najib Abdul Razak (pix) has filed an application to strike out Petaling Jaya Utara MP Tony Pua’s civil suit against him for misfeasance, which was filed last month.
Pua had filed the suit against Najib and the government, seeking a declaration that the Prime Minister had committed misfeasance in public office and a declaration that Najib abused his public office, in personally benefiting from his receipt of 1MDB funds.
According to Pua’s lawyer, Joanne Chua, Najib had filed an application to strike out the suit on Feb 14 and it was served to her on Thursday morning.
Among the grounds, Najib stated that Pua's suit was for political purpose and that he is not a public officer nor a government servant
Chua said the court had allowed Najib's application for a stay in filing his defence.
Senior Federal Counsel Zureen Elina Mohd Dom, who appeared for the government said the government would file an application to strike out within two weeks.
High Court judge Datuk John Louis O’Hara fixed March 7, 2017 for a case management in his chambers today.
