Govt files application to strike out Pua's suit against Najib

KUALA LUMPUR: The Government had filed an application to strike out Tony Pua's civil suit against Prime Minister Datuk Seri Najib Abdul Razak for alleged misfeasance in public office.
The application was filed on March 2, this year.
Senior Federal Counsel Zureen Elina Mohd Dom, who appeared for the government, said among the grounds of the application is that there is no cause of action against the government.
"The plaintiff (Pua) has no "locus standi" (no position to file the suit)," said Zureen.
Among other grounds include that there is no cause of action for misfeasance in public office and that the suit was filed out of time or time barred and that the matter is frivolous, vexatious and abuse of the court process.
High Court judge John Louis O'Hara fixed May 22, 2017 for a hearing of both the government and Najib's application.
On Feb 14, 2017, Najib had filed an application to strike out the suit and it was served to him on Thursday morning.
Pua said Najib had stated that it is a "collateral suit, which is filed for political purposes."
Pua, who is the MP Petaling Jaya Utara had filed the suit against Najib and the government, seeking a declaration that the Prime Minister had committed misfeasance in public office on Jan 16, 2017.
He is also seeking for a declaration that Najib abused his public office.
