Against-traffic girl to be charged under Road Transport Act 1987 not the Penal Code: Police

BUKIT MERTAJAM: The 19-year-old teenager who drove against traffic and caused a fatal accident will be charged for driving under the influence of alcohol at the magistrate's court tomorrow.
Central Seberang Perai district police chief ACP Nik Ros Azhan Nik Abdul Hamid said there was no truth to rumours that Ng Pei Ven was charged under Section 302 of the Penal Code for murder.
Nik Ros Azhan said the suspect would be charged under Section 44 (1) (a) of the Road Transport Act 1987.
He said the decision to charge her under the Road Transport Act was made by Attorney General Tan Sri Mohamed Apandi Ali after perusing the investigations papers on the case.
"The AG has agreed to charge the suspect under Section 44 (1) (a) of the Road Transport Act 1987 which carries a jail term of between three and 10 years or a fine of between RM8,000 and RM20,000 or both, if convicted," he told reporters.
Last Friday, Ng was charged with drug abuse under Section 15 (1) (a) of the Dangerous Drugs Act 1952.
If convicted, she faces a maximum jail term of two years or a fine of up to RM5,000.
In the 7.50am incident on March 14, Ng allegedly made a U-turn at KM128 of the North South Expressway (NSE), claiming she saw a stalled lorry.
The U-turn resulted in her going against traffic flow and she grazed against three vehicles but continued driving. The drivers of the three vehicles suffered light injuries.
She continued to drive for some 5km against traffic before crashing into the car driven by Mohamad Fandi Rosli, 26, at KM134 of the NSE killing him on the spot.
