Nazmi seeks to strike out charge for third time

SHAH ALAM: Selangor executive councillor Nik Nazmi Nik Ahmad (pix) will file an application to strike out his charge in relation to the "Blackout 505" rally, which he is facing for the third time, in three years.
Nik Nazmi, 33, claimed trial to the charge under the Peaceful Assembly Act 2012 (PAA), at the High Court today.
On Nov 3, 2015, the case was transferred to the High Court from the sessions court where he was charged for the third time on Oct 6, 2015.
Nik Nazmi's lawyer Syahredzan Johan said he will be filing the application by this week.
Nik Nazmi claimed trial to failing to inform the district police officer over the opposition rally at Kelana Jaya Stadium on May 8, 2013, three days after the 13th general election.
The Seri Setia assemblyman was charged for the first time in 2014. Later, he was discharged and acquitted by the Appeal Court on April 25, 2014.
Then, he was charged again but given an order of discharge not amounting to acquittal on May 6, 2014, by the sessions court.
DPP Wan Shaharuddin Wan Ladin suggested RM2,500 bail but Syahredzan argued that his client was given RM1,500 bail, when he was charged for the first time.
High Court judge Datuk Ghazali Cha fixed Feb 19, for mention and June 13 to June 16, for a trial. He also granted RM1,000 bail.
