Decision on Najib's, govt's application to strike out Tony Pua's suit on Oct 13

KUALA LUMPUR: The High Court today fixed Oct 13 for a decision on the application by Prime Minister Datuk Seri Najib Abdul Razak and the government of Malaysia to strike out a suit related to 1Malaysia Development Bhd (1MDB) brought by Petaling Jaya Utara Member of Parliament Tony Pua.

Judicial Commissioner Datin Faizah Jamaludin fixed the date in her chambers with counsel Datuk Mohd Hafarizam Harun who represented Najib while Pua was represented by counsel Gobind Singh Deo.
        
Mohd Hafarizam told reporters that the court also ordered the parties involved to submit the 1MDB's Adminstration Data.

Mohd Hafarizam said since the Prime Minister was not a director and a share-holder of the 1MDB, the documents should be submitted by the company itself.

Najib filed the application to strike out the suit by Pua on Feb 14 on the grounds that he was not a civil servant as claimed by Pua and said the suit abused the court process.

On March 2, the government also applied for the suit to be struck off on the grounds that Pua did not have any locus standi to submit the claims.

On Jan 16, Pua filed the suit against Najib for misfeasance in public office over the 1MDB issue and is seeking general, aggravated and exemplary damages, interest, cost and other relief deemed fit by the court. — Bernama
